Why a seller might ask to record

A seller asking to record the call is not necessarily a red flag. He or she might be nervous, trying to remember details, or perhaps has had a bad experience with another investor in the past.

It could also be a sign that he or she is taking the process seriously and wants a record for his or her own reference. Think of it as him or her doing his or her own due diligence, just like you do yours.

Your immediate, calm response

When a seller asks, simply say, 'Yes, that's perfectly fine with me. I'm happy for you to record our conversation.' Keep your tone even and reassuring.

Do not hesitate or sound surprised. Your calm acceptance helps build immediate rapport and shows you have nothing to hide. It sets a transparent tone for the rest of the discussion.

Setting expectations around the recording

After you agree, you can briefly mention what the call will cover. Say something like, 'Just so you know, I'll be asking some questions about the property and your situation to see if we can help.'

This frames the purpose of the call, whether it is recorded or not. It also gently guides the conversation back to your agenda without seeming to control the recording itself.

What to avoid saying or doing

Never express suspicion or ask 'Why?' in an accusatory tone. Do not make a big deal out of it. Responding negatively can make the seller defensive and shut down the conversation.

Avoid discussing the legality of recording without his or her permission. Your goal is to move past the request quickly and focus on his or her motivation and property details.

Turning it into a positive interaction

This request is an opportunity to show you are a straightforward person. By openly agreeing, you demonstrate transparency and professionalism, which are key to building trust.

You can even use it to reinforce your value proposition. Say, 'I appreciate you wanting a record. I believe in clear communication, and this helps ensure we are both on the same page.'

Legal considerations (not legal advice)

Remember that some states have 'one-party consent' laws for recording conversations, while others have 'two-party consent' laws. This means in some places, only one person on the call needs to know about the recording, but in others, everyone must consent.

Always confirm your state's laws if you are ever unsure about your own recording practices. However, when the seller brings it up and you agree, you have provided consent. This information is for educational purposes only and is not legal advice. Consult with a legal professional for specific guidance in your jurisdiction.

Questions people ask

Should I be worried if a seller asks to record?

Not necessarily. It usually means the seller is cautious or wants to remember details, which can be a sign of him or her taking the process seriously. Handle it with confidence and transparency.

What if I don't want the call recorded?

You always have the right to decline, but it is better to agree if you can. If you must decline, politely state that you prefer not to be recorded and offer to take notes or send a summary after the call. Be prepared for the seller to end the conversation.

Does recording mean he is not serious?

No, it often indicates the opposite. A seller who asks to record might be more engaged and diligent. He or she wants to ensure he or she understands everything and has a clear record for his or her decision-making process.
